Forfeiture case junked on account of inordinate delay

MANILA, Philippines — The Court docket of Appeals (CA) has dismissed the civil forfeiture case filed by the Anti-Cash Laundering Council (AMLC) in opposition to three people allegedly concerned within the multi-billion peso pork barrel scandal.

In a 17-page ruling dated Oct. 17, the CA’s Ninth Division granted the petition for certiorari of Hector Ang, Jacqueline Ang, and Nicole Tiffany Ang, who sought to overturn the Manila Regional Trial Court docket’s 2022 determination to dismiss their movement to dismiss the case.

Of their attraction to the CA, the petitioners argued that their constitutional proper to a speedy trial was violated as a result of it took eight years and 5 months between the submission of the final pleading and the conduct of the pretrial.

In granting the petition, the appellate courtroom emphasised that the best to speedy disposition of circumstances is assured by Part 16, Article III of the Structure.
